DEFINITIONS:
Durawise Industry services here after referred to as “DWIS”
Client, contractor, renovation contractor and the term others are used to describe the DWIS hiring party.
Accessible means being able to be seated with test plug equipment in existing conditions, removed without damage, not seized in place, nor any other condition that would prevent standard test operations.
Invasive Locates: requiring digging, drilling, deck removals, cutting of underground plumbing etc. This is rarely needed.
Standard Locates: Each leak detection comes with one (1) hour standard locate. In rare cases, it takes longer to get a leak to ideal conditions for location equipment to narrow down to the perspective area.
Observation Report: This "Observation Report" is for informational purposes only. The “Observation Report” may not depict accurate size, scale, nor locations. It is based on approximate locations only. All pipe locates below grade are based on equipment readings, and sound. Please note this is not an inspection report.
Pressure Tests: A pressure test is used to check your pipe’s ability to hold a defined amount of pressure for the time period depicted. In this case, it is used to check for active leaks or breaks in the pipe run that allows your water to escape. Heaters, air raters, filters and other equipment are not pressure tested; pressure tests are used to check for leaks at underground piping. Typically, a pressure test will be from the nearest connection point before the pipe goes underground to a pool side inlet/ outlet.
A) Zone: Pressure tests are broken into Zones. "Zone" meaning what was included in a particular pressure test between point locations specified. Different pipe runs (example: spa floor water feature vs. pool returns), may be combined in one "Zone" due to equipment construction or for time constraints. A "Zone" is decided on a case-by-case basis. Depending on the length of a Zone, Durawise Industry Services will hold a pressure test for 1-10 minutes. An example of a shorter time one (1) minute would be skimmer to pool, with a pipe run of less than 3'-0".
B) Plugs: A pressure test relies on a good plug seal. A plug may not seal properly because of blistering/bubbling, fitting construction, previous repairs, and other instances. Forcing leak detectors to use extensions, inflatables, and other products to perform pressure tests. All fittings in this instance will be dye tested; however, ground water and debris can affect dye pull. See "Perceptibility Testing" below.
1) Water Features: Water features, such as shear descents and rock features are typically not constructed to allow for proper pressure testing. Due to these reasons, water features are typically not pressure tested. The exterior of the water features will be checked for water-loss. A customer may opt for a more in-depth/invasive test at additional charge.
2) Equipment Construction: Equipment may not be constructed to allow for a pressure test. In these cases, homeowner will be provided options to allow for testing. Options could be cutting, taps, and other methods; however, options will be an additional charge that will be disclosed at the time of the leak detection. Costs for options will be competitive.
C) Locates: The term "Locate" is a reference to breaks in pipes that are underground and cannot be seen from the surface. Durawise Industry Services has three (3) pieces of equipment (manufactured by others) to help narrow down leak locations; however, ground water, hallowed ground under decks, other underground utilities/pipes, and surrounding noise pollution can affect the results of a locate. For these reasons Durawise Industry Services notates "Locates" with one of three symbols:
1) " "Narrowed Break Locate" this means the devices have picked up a break and the location has been identified in the general location. (Typical)
2) " "Tentative Break Locate" this means the leak detector has reason to believe there may be a break within this location that cannot be confirmed or has reason to believe a second break exists within a "Zone" based on noises picked up. The leak detector will notate specific reasons for use of this symbol and in most cases provide a plan of action. (Rare Instances)
3) " " Impeded Break Locate" this means the leak detector cannot pinpoint a leak into a general location. This can be due to echoing, surrounding drainage, hollowed decks, washouts, discarded deadlines, sleeved pipes, and other underlying conditions below grade. The leak detector will notate issues. In order to find the break, an invasive locate will be required at additional fees. (Rare Instances).
****Please note: Air and water takes the least path of resistance. This means more than one break can be in any "Zone". Therefore, at the time of repair or after the repair an additional pressure test is recommended. This is at an additional charge. Change orders may be requested to pinpoint "Tentative Break Locate" and/or "Impeded Break Locates.”
Perceptibility Testing: Dye is used to observe underwater movement. Dye tests can be impeded by debris, low water-level, ground water and other issues. Some items may not pull dye one day and start taking on water later. (An example of this on multiple projects is the drain housing. After heavy rain, customers have reported they lost less water or did not notice the loss at all. About a week or so after the rain stopped, the loss started again.
Water Monitoring Testing: This is an estimated water loss based on conditions of the date and time the test was ran. If your pool was selected to have a water monitoring test run, please read over all the information provided on the forms. This is typically two pages or more. Water monitoring testing is an additional charge and will/may not be performed unless specifically requested.
Equipment: The equipment pad will be checked for visible water leaks while the system is running. This is based on accessibility. This does not include air leaks. If an air leak is identified, it will be notated.
GENERAL: Durawise Industry Services “DWIS” will make every effort to accurately locate a leak within a swimming pool, spa, and/or basin. DWIS performs leak detections based on knowledge and previous experience. All pricing is provided as an estimated cost based on the information provided. Any unforeseen conditions may result in deduct or add cost changes. A customer understands and agrees that charges for a leak detection are based on DWIS using acoustical amplification, pressure testing, and perceptibility dye testing. Therefore, we have established warranty, changes, liability, payments /mechanics lien warning, and guarantee disclaimers below. By using Durawise Industry Services you agree to all terms and conditions listed below.
WEATHER REQUIREMENTS: All leak detections will be scheduled based on weather data provided available on the date and time of the scheduling. DWIS equipment cannot be used in rain, nor at times that have risk of lightning. If rain is forecasted, DWIS may choose to reschedule or stop the leak detection, due to the risk of equipment damage. If lightning is within sixty (60) miles of site, the leak detection will be called and rescheduled for another date. If a lightning storm is outside of the leak detection site and is on track to be within thirty miles of the site due to speed. The leak detection will be called and rescheduled for the next available date. With regards to temperatures, DWIS personnel cannot dive a pool if temperatures have plummeted below forty (40) degrees Fahrenheit within seventy-two (72) hours within the leak detection date. If the pool area is shaded or a residential structure is blocking the pool from sunlight throughout the day. Temperatures must be at least fifty (50) degrees Fahrenheit for seventy (72) hours. Temperatures and weather conditions must be good and within DWIS operational ranges for the leak detection to commence on the scheduled date. Tornado and hail forecasts may also be cause for rescheduling. In the event of weather-related rescheduling, there will not be an additional charge to DWIS clients, unless the customer insists or encourages DWIS to pursue the original schedule date and DWIS accepts based on additional compensation. The owner of DWIS can be the only one to agree to perform services outside of the ranges and will be the one needed to execute the services in such conditions. Any other person does not have the right, nor the authority to perform services outside of these ranges. Only DWIS approved personnel can complete services within these ranges. By committing to being a DWIS client, you agree that safety of equipment and personnel is the responsibility of all parties involved and understand rescheduling due to weather may occur.
ESTIMATES: Estimates are provided based on information received and DWIS interpretation. All estimates are provided for leak detection services are based on checking all accessible zones within DWIS guidelines of standard pool fittings and fixtures. Accessible meaning that the fittings and/or fixtures can be removed without risk of breaking or tearing. In addition, the openings must allow for a seal fit by pressure test equipment. All estimates are based on one (1) filter pump, pool only, and gunite/shotcrete construction unless notated otherwise. All estimates are based on one equipment pad area unless notated otherwise. Meaning obstructions and other items may limit the leak detector’s ability to test specific items. Specialty features are not included in standard leak detection costs and will need to be priced separately in phased pricing. Specialty features include, but are limited to cannisters, colorscades, venturi skimmers, in-ground floor systems, storage tanks, slides, water features toys, shear descents, rock water features, basins, scuppers, deck sprayers, venturi bench systems, paramount systems, more that five (5) poly jets, cascading light bubblers, care-taker systems, and other features outside of simple skimmers, drains, and pool/spa returns. Further estimates will not include the removal of metal grates, specialty rocks/gravel/slabs, nor other non-typical items. In addition, pricing is based on all equipment being testable at time of leak detection. Meaning if cutting is required to complete a test, an additional charge will apply. Further, estimates are based on accessibility. Meaning that pathways are free and clear of obstacles and there is at least a twenty-four (24”) inch width path minimum for equipment to be rolled into areas. Parking must be available within one hundred and sixty (160’) feet of the pool area measured by walking areas or there will be an upcharge for equipment transportation time to the pool area and back for loading. Commercial and multifamily projects must be within sixty (60’) feet of the pool area.
PREPARATION: The client will ensure that the pool is clean, clear, equipment is operational, and pool is filled with water to operating level for the date and time of the leak detection. If the pool is green and/or not sanitary and the pool cannot be cleaned, DWIS should be notified before the scheduled date. It is imperative the water be filled as close to operating level as possible. Anything outside of operational levels may be missed during perceptibility testing, which takes place below the pool water surface. Shock, acid, flocculants, and other pool chemicals should not be added to the pool within twenty (24) hours of the visit, unless all chemicals will be dissolved in the water and/or removed from the water by the leak detection time and date. Otherwise, rescheduling of the leak detection will be required.
POOL SURFACE FINISHES: Painted surfaces may wear, flake, and/or remove during leak service operations. All other pool surfaces may delaminate and/or crack if weakened or voided areas exist as the leak detector steps across the pool. DWIS assumes no liability for repairs to surfaces that have existing or underlying issues. See draining for other issues.
POOL CHEMICALS AND BALANCING: The hiring contractor or property owner will be responsible for pool chemicals, cleaning, and balancing. DWIS assumes no responsibility, nor liability for pool maintenance and cleaning.
WATER FEES: Durawise Industry Services will not pay any utility fees.
ONSITE UTILITIES: Durawise Industry Services will use onsite water and electricity for leak detection operations. If DWIS is required to bring water and/or a generator it will be at additional charge of seventy-five ($ 75.00) dollars for DWIS to bring a generator and $ 17.23 per gallon for water costs and special equipment to transfer water from one line to another for location purposes. DWIS will need to be notified at time of order if this is a requirement. If DWIS is not notified a mobilization fee will apply.
FEES AND ADDITIONAL COSTS: Repairs are an additional charge and will not be priced until leak issues have been uncovered. Each pool location is different, DWIS has made this section for differentiation in pricing. This ensures each customer is billed based on their specific site. If the pool is completely testable and all zones are accessible (without the need for cutting, chiseling, nor demolishing materials), there will be no additional cutting fee charges. If, however, cutting, or other removal work is required such as the removal of seized fittings, there will be an additional charge. There will be a ten to seventy-five ($ 10.00-$75.00) dollars charge for each cut at equipment/demolished fitting/fixture depending on risk, plus material replacement costs plus mark up. If yellow or black algae is present, there will be a nine ($ 9.00) dollar plus tax charge for the cleaning of equipment used on the leak detection. If DWIS is scheduled and the pool is not ready as described within these terms or conditions, there is no access, or dog present in the backyard that cannot be removed. A mobilization charge of two hundred and fifty ($ 250.00) dollars plus tax will be charged to the ordering client. If a client fails to cancel or reschedule within forty-eight (48) hours of a scheduled appointment, there will be a twenty-five ($ 25) dollar fee. If a client cancels the day of the appointment, a mobilization fee will apply. Plugs required to plug off areas will be five to forty-five ($5.00 - $45.00) dollar charge plus tax for material costs. If plug is placed at time of leak detection, there will be no labor charge for areas that can be simply plugged. If work is required to seat the plug or it is requested after the leak detection is completed and a return trip is required, additional costs will be required. Equipment cutting and capping fees will be an additional charge. Additional work will be priced based on time and materials.
GROUNDWATER AND GROUND MOVEMENT: Ground water and rain affecting certain soil conditions can temporarily slow or stop certain leaks, until conditions subside. Meaning a leak may temporarily slow down within a swimming pool or appear to stop all together until certain the groundwater subsides. In addition, rain and ground water can cause ground movement/settlement. This in turn can cause leaks. On the other hand, drought and temperature changes can cause ground movement. In addition, adjoining property leaks can offset leak conditions depending on path and volume of water being lost. Due to conditions below grade, any future leak issues are unforeseeable. Therefore, all leak detections are performed on a best effort basis and information will be documented from observations made on the date of the visit. DWIS will not be held liable for future conditions that result from ground movement, ground settling, temperature changes, droughts, freezes, rain, or other unforeseeable conditions that may arise. DWIS assumes no responsibility for any damage caused by ground water or pool leaks. DWIS will take all reasonable steps to locate leaks within the services ordered, but it is impossible to guarantee no leaks will occur after the date of the visit.
EXISTING CONSTRUCTION: DWIS did not install the pool, home, adjust grading, nor dictate drainage onsite. Therefore, DWIS will not be responsible for leaks that cause potential washouts, flooding, nor other issues that may arise. In addition, DWIS will not be responsible for faulty, defective, damaged, nor worn construction/fixtures onsite.
DEBRIS: As mentioned earlier, leak detections are based on observations made on the date of the visit. Leaks can occur due to ground movement after the date of the visit. Ideally, leak detection for upcoming renovations will be performed in a clean and clear pool that is operational and filtering at time of the leak detection. If the pool is drained, the leak detection should ideally be performed within a few days of draining a clean, clear, and operational pool. Debris can temporarily clog a leak giving a false reading on the date of the test. While this is rare, it will only come to light once the pool is operational and water flowing with the power of the pump has cleared the line. DWIS takes no responsibility for unforeseen debris clogs.
RENOVATIONS: The renovator or homeowner will be responsible for contacting DWIS when they feel they are ready for leak testing services. DWIS recommends testing before a renovation, and after any deck work is executed. Please note, DWIS will test all lines underestimated scope of work. As mentioned earlier, specialty features are not included, unless agreed upon otherwise. The return fitting connections and other connections placed at the time of plaster work will not be included in the tests. DWIS will not enter a freshly plastered pool without express permission from authorized supervisors onsite and/or the plaster companies’ permission. If after care is commencing DWIS will not enter the pool, until it has been completed. Any authorized/approved entry that results in damage to existing plaster, will not be covered by DWIS, because we requested permission and authorization from others. DWIS leak observations will be performed based on information gathered that day. DWIS will not be liable for any unforeseeable leaks that occur because of ground movement, settling, weather, temperatures, overfilling, drought conditions, other’s workmanship, and filling/draining operations. DWIS will not be responsible for maintaining hydrostatic pressure between ground water and pool. DWIS will not remove green slim or other debris from an empty pool, nor fixtures such as skimmers to pressure test. This will be the responsibility of hiring renovation contractor. If debris exists, the area will not be tested. If DWIS must remove debris to complete testing, there will be a minimum add cost charge of $175.00 plus tax and haul off fees if required. Haul-Off not to exceed four cubic feet of materials or 100 lbs., whichever is less. DWIS will not haul off chemicals, hazardous materials, nor biological materials.
DRAINING AND FILLING A POOL: Risks do exist in draining a pool. Filling a pool also poses risks after it has been drained. Take a pool for example that has roughly 10,000 gallons of water and multiply that by 8.34 lbs. per gallon you get 83,400 lbs. of water. That is a lot of weight to remove and then place back. While a pipe break would be rare, the chance still exists based on soil conditions and any unknown pipes that are near a break point. Therefore, there is a risk of pipes breaking when draining and filling the pool. In addition, there is a risk of pop-ups. Meaning ground water pressure could push your pool out of the ground. This can cause damage to pipe, fittings, fixtures, and the shell. In addition to the expense required to get the pool back into the ground. Also, pool cracks, egging, and other issues may arise from draining the pool. DWIS will not be held liable for issues that may arise due to draining operations. Even if DWIS is hired to drain the pool. DWIS does not recommend draining the pool in areas with springs and/or during rainy seasons. DWIS recommends the hydrostatic plug be pulled or other avenues be taken to relieve hydrostatic pressure.
WARRANTY: Durawise Industry Services will provide a leak detection warranty for twenty (20) days, as of 04/25/2023, on all full leak detection packages. This warranty covers an additional leak detection cost to be performed by Durawise Industry Services only one additional time. This warranty will be executed using the same services previously ordered; however, if there are specialty features, they will need to be tested for an additional cost before a warranty can be used. It will be the responsibility of the customer to notify Durawise Industry Services of any continued water-loss and schedule for an additional leak-detection during the warranty period. There will be an upcharge for visits that result in repairs made by others or repairs on zones completed by others. The timeline for leak detection warranty periods will be twenty days from the first leak detection date performed on site. Durawise Industry Services is not responsible for leaks in zones/fittings/fixtures that weren’t originally tested. Due to redundancy and proprietary information, perceptibility dye testing will only be referenced on leak reports if a leak was found. All temporary patches are placed free of charge and at client’s risk of future leak occurrences. Temporary putty patches will not be covered under any warranty, minor repairs will be warrantied for ninety (90) days, and major repairs will be warrantied for one (1) year, unless notated otherwise in the repair closeout documentation. Repair warranties will be dated from the date the initial work was completed. The procedure for filing any warranty claim is to notify Durawise Industry Services (See Contact Information Below). Any repair performed by Durawise Industry Services will be performed with standard parts and labor warranty only. Testing for leaks discovered outside of the warranty will be an additional charge. Any scope of work executed by others.
If undetected leaks cause any damage between DWIS visits or thereafter, then DWIS accepts no responsibility for any damage instances. Leaks occur due to movement and washouts.
It is the customer’s responsibility to continue to monitor the situation after DWIS has left and call us back as necessary to investigate any on-going leak issues. Please monitor and state the problem, location, water-loss per day, defects to the pool, and provide copies of the last two water bills for usage purposes only. This can be accomplished by using any of the three contact methods below.

There are no other warranties by Durawise Industry Services of any nature whatsoever expressed nor implied including any warranty of accountability or fitness for a particular purpose in connection with our services or products.
GUARANTEE: DWIS will strive to provide the best customer service, leak finds and fixes. Due to the nature of underground construction and unforeseen conditions, no guarantees are made, nor implied. All leak detections are performed on a best effort basis at the time and date of the leak detection. Durawise Industry Services will provide an invoice notating observation finding within the pool or spa area. It will be notated with leaks found during pressure testing or dye testing. (Example: Pool returns failed.) If a customer opts for a leak summary only the leaks found will be notated. If a customer opts to have an observation report and pays the additional fee, all pressure test information, location information, and leaks discovered during the leak detection will be provided. All leak detections are performed on a best effort basis at the time and date of the leak detection. Durawise Industry Services prices vary based on construction, grading, finish, amenities, size, distance of location, and fixtures.
OUR SWIMMING POOL LEAK DETECTION IS GUARANTEED FOR 20 DAYS FROM THE DATE OF THE ORIGINAL TESTING. Most leaks, with the EXCEPTION of sleeved pipes which will be marked for reroute, will be located within several feet of their exact location, but this can vary to within several yards, depending on soil conditions, construction methods, and other factors, known and unknown. If the leak has created a washout or if there are deadlines, the pool leak can travel further distances. In addition, certain soil conditions can impede sound detection methods. In these instances, invasive locates will be required. DURAWISE INDUSTRY SERVICES must be notified immediately if repairs are performed by anyone other than DURAWISE INDUSTRY SERVICES and the leak is not located within a radius of 8 feet of the original identified point. DURAWISE INDUSTRY SERVICES will, at its sole discretion, either retest the system or refund the leak detection location cost only (. DURAWISE INDUSTRY SERVICES will not be responsible for any repair completed by others, and accepts no liability, financial or otherwise, for any consequential losses arising from the inaccurate location of leaks in excess of the location fee paid. Sleeved pipes and buried deadlines running along the PVC are excluded from any DURAWISE INDUSTRY SERVICES “DWIS” guarantee.
PVC LINES, COPPER, AND FLEX LINE DISCLAIMER: Durawise Industry Services makes every effort to minimize pressure on existing lines. PVC, Glue, Copper lines and Flex lines may be degraded. Without exposing each individual line there is no way to tell before a test commences on the conditions of such lines. Durawise Industry Services tests with water and/or air at 10 - 25 PSI for 5 minutes for PVC (Depending on Length of Pipe Run from Pool to Equipment). If copper lines and/or flex lines are visually identified, the following pressure tests will be performed: Copper lines 5 -10 psi depending on conditions with water and black flex lines not to exceed 7 psi. Both copper and flex lines will be held for 10 minutes only. The identification for existing copper and flex lines will be based on equipment piping and visuals from the surface of the pool to inlets. Please note: Copper, flex, and joint materials may be on the verge of failing. A pressure test may cause unanticipated failures in weak materials.
In most cases, only one leak can be located in a pool zone at a time. Therefore, it is important to retest the line after a repair is completed. DURAWISE INDUSTRY SERVICES will notify the customer of cost changes for additional work.
LIABILITY: Leaks can be intermittent, i.e., only leak under certain circumstances. For example, some leaks only occur when the system is on and/or running. Leaks of this nature can be much harder to locate. In addition, washouts may make pinpointing a leak impossible without invasive methods. All invasive methods will result in additional costs. Durawise Industry Services shall not be liable under any legal theory for special or consequential damages. Durawise Industry Services will not be responsible for any other repairs except the repairs that we originally performed. Cost as to water replacement, chemicals, land, and loss of use are not covered. Durawise Industry Services will not be responsible for any damage due to hydrostatic pressure, nor water. If undetected leaks cause any damage between our visits or thereafter, DWIS accepts no responsibility for such damage. Durawise Industry Services will not be responsible for any damage due to any acts of nature (freezes, ground movement, earthquake, hurricane, tornado, hail, etc.). Durawise Industry Services will not be responsible for damage arising from any leaks, previous repairs performed, or draining of pool. Durawise Industry Services will not be responsible for any pool plaster or pool surfaces. Durawise Industry Services will not be responsible for underground utility lines (fiber optic, gas, electrical, etc.…..)
Leak detection addresses only those components and conditions that are present, visible, and accessible at the time of the assessment. DWIS leak detection package does not include specialty items such as inground floor systems, scuppers, rock water features, storage tanks, shear descents, statue fountains, deck sprayers, cannisters, paramount systems, care take systems, storage tanks, auto-fills, backwashes lines, metal sprayers, etc. Specialty features will be an additional charge. The technician is not required to move furnishings or stored items. If DWIS technician moves furnishings or stored items, out of access areas DWIS assumes no responsibility for scratches or defects. The observation report may address issues that are code-based or may refer to a particular-code; however, this is NOT a code compliance detection and does NOT verify compliance with manufacturer’s installation instructions, local, state, or federal requirements. The observation report does NOT imply coverage nor warranty of the structure nor its components, as a leak detection company did not build nor install components. Although some safety issues may be addressed in this report, this observation is NOT safety/code detection, and Durawise Industry Services is NOT required to identify all potential hazards. Durawise Industry Services does NOT provide residential installer reports, real estate inspection reports, engineering reports, CPI/CPO reports nor any other licensed agent reports. As determined by the consumer, he/she will be responsible for hiring third party licensed parties as they see fit. Durawise Industry Services will not be responsible for hiring third parties.
In the observation report, Durawise Industry Services personnel will note which areas or components were observed to be leaking. Other general deficiencies include viewed, material distress, water penetration, damage, and deterioration will not be listed if not viewed. Temporary plug patches may be provided by Durawise Industry Services if they are smaller than a quarter and can be easily reached. Durawise Industry Service’s personnel are not required to prioritize or emphasize the importance of one deficiency over another. Some items reported as deficient may be considered life-safety upgrades to the property. The leak reports are considered to provide information on observed leaks only. It may not outline all deficiencies, nor mention unrelated work. The provided observation report is the exclusive property of Durawise Industry Services and its use by any unauthorized persons is strictly prohibited. The observations and opinions expressed within this report are those of Durawise Industry Services and supersede any alleged verbal comments. Durawise Industry Services only performs repairs on recirculated swimming pool piping. Larger repairs that are typically repaired during a renovation may be plugged and/or bypassed until such a date occurs. Repairs that fall outside of leak detection services need to be classified as gluing, splicing, gravity feeds, injections, plugging, patching, replacement/repairs, fiberglass repairs, patches, and injections. These repairs will fall under a separate contract or be added to the contract with a change order. Durawise Industry Services does not perform work on electrical, irrigation systems, plumbing (auto-fills, sewer, sanitary water, etc.), nor gas fixtures. It will be the responsibility of the property owner, agent, or contractor to secure third party licensed contractors to perform such repairs. Every effort will be taken to protect furniture and vegetation surrounding the pool; however, it will be the responsibility of the owner to remove any items from repair locations he/her/it/it’s would like to salvage. Water pressure, food grade materials, dyes, soap, video cameras, tracking flags, and/or tracing equipment may be inserted into the line to track the location of swimming pool lines to identify any leaks and/or breaks that may exist. Should equipment become lodged in a line, it may require excavation of the line to retrieve the equipment or complete the detection, an additional charge will apply. A jetting process may be required, and an additional charge will apply if blockage is observed during the swimming pool leak detection. NOTE: ALL LEAK DETECTION OBSERVATIONS ARE
GUARANTEED TO BE ACCURATE AT TIME OF SERVICE ONLY. Durawise Industry Services cannot guarantee future leaks from freezing conditions, vegetation, improper drainage, acts of God, theft, removal, ground movement, hydrostatic pressure, droughts, flooding, power surge, environmental stress, and other internal/external factors.
To properly perform leak detections, we will need the pool to be filled three inches below the bottom of coping or deck lines from the highest point of each body of water. The water level needs to be a minimum of 3” above skimmer mouth openings. The pool equipment will need to be in the off position at least thirty minutes before arrival and the water must be clear and free of debris so that all aspects of the shell can be observed without interference. This will ensure a nice calm pool to help detection accuracy. We may need to remove pool or spa covers and accessories may need to be cut. If these items have not been used or manipulated recently, they may break and/or begin to leak. To locate some leaks, it may be necessary to empty the pool or spa. Caution should be used when emptying a pool, spa, or basin to ensure it does not float out of the ground. Durawise Industry Services will only perform a pool drain with a waiver of liability form signed by all owners who have a stake in the property. Regardless of the form, DWIS assumes no liability for damages that result from draining operations. If project customer/contact fails to provide all owner’s information with stake in the property, Durawise Industry Services will assume waiver submissions received equal up to one hundred percent of ownership and will assume no liability for owner’s that were not notified nor given the opportunity to view risks. By agreeing to the estimate form and/or DocuSign forms you agree to all terms and conditions. Furthermore, if the pool level is not up and the system is on at time of arrival, no guarantees can be made that a thorough leak detection can be performed on the shell and pipes at the shell due to currents and unsubmerged surface.
FOUNTAINS: Not all fountains can be tested. Some are inaccessible and others do not have plugs available on the open market to fit certain openings. In these cases, Durawise Industry Services may provide additional cost options to test the lines; however, without visually seeing the cracked, fissured, or compromised pipe/structure no guarantees are expressed, nor implied.
HEATING SYSTEMS: Durawise Industry Services does not pressure test heating systems and assumes no liability, cost for repairs, nor other associated costs for repair or replacement.
LIGHTS: Conduit lines will not be pressure tested.
POST-TENSION CONCRETE: DURAWISE INDUSTRY SERVICES will not be responsible for rebar, nor post tension damage. Customer must disclose post tension construction, before repairs are priced. It will be the owner, agent, or third-party pool contractor’s responsibility to verify that post tension cables are not present within the repair location. Durawise Industry Services does not locate rebar, nor post tension reinforcement.
STONE AND CONCRETE DECKS: Durawise Industry Services will attempt a near match to existing surrounding conditions; however, there are no express guarantees because of material availability, site weatherization, and other factors the repair will be unnoticeable to the human eye.
UTILITY TRACE: DURAWISE INDUSTRY SERVICES acknowledges that successfully locating utilities is an art as well as a science. Knowing the types and locations of underground utilities on your site is an important and cost-effective way to ensure a safe and successful project. That is why a dig test will need to be performed on digs that exceed two feet. Texas 811 will need to be contacted by the renovation contractor supervising DWIS subcontract and/or by the client three days before repairs are set to be made. Locates and repairs will be an additional charge and may delay a repair up to four days. Our team uses hand digging methods on most projects; however, DURAWISE INDUSTRY SERVICES makes no guarantee, implied or otherwise, that it can ensure no damage to surrounding utilities and assumes no liability cost or other litigation for damage to surrounding utilities, cables, lines, nor equipment.
ASBESTOS, LEAD & MOLD: Asbestos and Lead are common building materials that may be present in many buildings constructed prior to 1981. DURAWISE INDUSTRY SERVICES, adhering to Federal law, will exercise reasonable precautions to minimize the chance of disturbance of asbestos containing materials. However, certain procedures require the removal of materials within a wall. In addition, DURAWISE INDUSTRY SERVICES is not and will not be responsible for the removal of any mold, asbestos or other material hazards observed before, during or after our services. This is unlikely to be an issue; however, it needs to be addressed for potential occurrences. Property owners, agents, and contractors will hold Durawise Industry Services harmless and impose no cost for removal, abatement, nor liability on Durawise Industry Services/ personnel.
PAYMENTS/MECHANIC’S LIENS: Payments are always due upon the completion of services rendered the date of visit(s). This means once a Durawise Industry Services representative has completed the leak detection, pressured lines, or performed other services and DWIS is ready to be compensated for work performed a bill will be presented. A verbal agreement and/or estimate must be approved before changes can commence. A pool contractor may request a payment extension up to 14 days from the date services have been rendered, on the basis credit has been pre-approved. Services rendered and not paid is considered theft of service and a mechanics line will be filed. Customer/Client(s) hereby agrees to pay all costs of collection, administration fees, attorney’s fees, and court costs. A finance charge of 3% annual charge will be charged from the date of completion to collection date. All returned checks/payments will be subject to a fifty ($ 50.00) dollar return payment fee. It is not DWIS wish to lien a property. If a client needs payment arrangements, DWIS will be willing to work with clients in need of help under certain conditions. Liens will only be placed under extreme circumstances and will be executed under the guidelines of Texas law.
States of Texas Know Your Rights: “Under the Texas Mechanics’ Lien Law, any contractor, subcontractor, laborer, supplier or other person or entity who helps to improve your property but is not paid for his or her work or supplies, has the right to place a lien on your home, land, or property where the work was performed and to sue you in court to obtain payment.
This means that after a court hearing, your home, land, and property could be sold by a court officer and the proceeds of the sale are used to satisfy what you owe. This can happen even if you have paid your contractor in full if the contractor’s subcontractors, laborers, or suppliers remain unpaid. To preserve their rights to file a claim or lien against your property certain claimants such as subcontractors or material suppliers are each required to provide you with a document called a “Preliminary Notice”. Contractors and laborers who contract with owners directly do not have to provide such notice since you are aware of their existence as an owner. A preliminary notice is not a lien against your property. Its purpose is to notify you of persons or entities that may have a right to file a lien against your property if they are not paid. To protect their lien rights, a contractor, subcontractor, supplier, or laborer must file a mechanics’ lien with the county recorder which then becomes a recorded lien against your property. Generally, the maximum time allowed for filing a mechanics’ lien against your property is up to forty-five (45) days after substantial completion of your project. Durawise Industry Services will pay all subcontractors and suppliers. Therefore, we rely on and expect customers to pay us. At the beginning of any project, a customer may ask about our in-house financing. Once a project has commenced, this option may not be available.
